Important Contractual Notice

These Terms and Conditions govern your use of the website operated by Fire Damage Restoration Dallas (doing business as Fire Damage Restoration Dallas) and apply to all emergency dispatch requests, initial on-site stabilization, and subsequent general contracting reconstruction projects executed across Dallas, Texas.

1Agreement to Terms

By accessing this website, submitting an emergency response dispatch form, or engaging Fire Damage Restoration Dallas (“Company,” “we,” “us,” or “our”) for structural stabilization, smoke mitigation, water extraction, or fire reconstruction, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions and our Privacy Policy.

2Emergency Dispatch & Property Right of Entry

When you contact our 24/7 technical dispatch hotline at (214) 555-0147 or submit an electronic emergency request:

  • Authority to Contract: You represent and warrant that you are the lawful legal property owner, authorized corporate representative, or managing agent possessing legal authority to grant access and execute emergency mitigation authorizations for the property.
  • Right of Entry for Stabilization: You grant our technicians, mobile units, and equipment full right of entry to inspect the premises, secure compromised door/window openings with CDX plywood, apply weatherproof roof tarps, and deploy air scrubbers and dehumidifiers to prevent escalating structural deterioration.
  • Municipal & Fire Marshal Releases: Crews will not cross active yellow emergency tape or enter burned structures until Dallas Fire-Rescue (DFR) or the municipal Fire Marshal has officially concluded investigation activities and declared the scene safe for restoration entry.

3Two-Phase Restoration Framework: Mitigation vs. Reconstruction

In compliance with standard insurance restoration conventions and Texas construction regulations, services are performed in two distinct, coordinated operational phases:

Phase I

Emergency Mitigation

Performed under an emergency Work Authorization / Emergency Service Agreement. Encompasses immediate board-up, roof tarping, fire suppression water extraction, structural shoring, antimicrobial stabilization, and HEPA air filtration to halt secondary loss.

Phase II

Turnkey Reconstruction

Performed under a formal Texas General Construction Contract. Encompasses engineered framing, City of Dallas building permits, MEP rough-ins, drywall, insulation, flooring, cabinetry, roofing shingles, and municipal code sign-offs.

4Insurance Coordination, Scope Approval & Deductibles

As a service to property owners, we assist with insurance claim documentation using industry-standard Xactimate® estimating software with Dallas County price benchmarking:

Texas Insurance Code & Deductible Notice (Tex. Ins. Code § 707.001)

Under Texas law, it is illegal for a contractor or any third party to pay, waive, absorb, rebate, or credit all or part of an insurance deductible for property damage repairs. The property owner is legally obligated under Texas law and their insurance contract to pay the deductible specified in their property policy directly to the contractor.

  • Payment Responsibility: While we coordinate directly with insurance carriers regarding scope agreements and supplemental items, the property owner remains contractually responsible for all authorized work, deductibles, betterment upgrades, or non-covered damages.
  • Direction to Pay: Property owners may execute a standard Direction to Pay instructing their carrier to release insurance proceeds directly to Fire Damage Restoration Dallas for completed milestones.

5City of Dallas Municipal Permitting & Licensing

As a registered State of Texas General Contractor, we secure all necessary structural, electrical, mechanical, and plumbing permits through the City of Dallas Sustainable Development and Construction Department (Oak Cliff Municipal Center) in compliance with City of Dallas Chapter 53 Building Regulations, the International Building Code (IBC), and International Residential Code (IRC). Reconstruction will not proceed to subsequent phases until municipal building inspectors complete required framing, rough-in, and final inspections.

6Client Responsibilities & Site Safety

To safeguard health and enable rapid property recovery, clients agree to:

  • Maintain safe clearance from active negative air pressure zones, hazardous soot containment chambers, and open framing areas.
  • Refrain from turning off or unplugging commercial air scrubbers, desiccant dehumidifiers, or hydroxyl generators without prior authorization from our technical crew lead.
  • Identify high-value personal property, firearms, currency, jewelry, and vital family documents for prioritized emergency pack-out and vault transfer.

7Workmanship Warranties & Limitation of Liability

We take immense pride in our craftsmanship. Turnkey reconstruction workmanship is backed by a one-year standard contractor warranty covering structural framing, drywall, finish trim, and roofing installation. Manufacturer warranties (such as Owens Corning roofing shingles or HVAC units) are transferred directly to the property owner.

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE TEXAS LAW, COMPANY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES RESULTING FROM PRE-EXISTING STRUCTURAL DEFECTS, HIDDEN LATENT CONTAMINATION, DELAYS OCCASIONED BY DALLAS FIRE-RESCUE SCENE LOCKDOWNS, MUNICIPAL PERMIT BACKLOGS, OR SEVERE ACTS OF NATURE (SUCH AS TORNADOES OR WINTER FREEZES).

8Governing Law & Dallas County Venue

These Terms and Conditions, all service agreements, and any disputes arising between the parties shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any legal action, suit, or proceeding arising under or in connection with our services shall be instituted exclusively in the state or federal courts located within Dallas County, Texas.
